Terms and Conditions
These terms govern the use of the Data Center Simulator software and of this website. By downloading the software, buying a licence or using the site you agree to them. They are written to be read, not skimmed: each section says one thing.
1. Who we are
Data Center Simulator (“we”, “us”) is desktop software published by Eng. Moataz El Sherif, Cairo, Egypt, and sold through this website, datacentersimulator.net. You can reach us at Sales@datacentersimulator.net.
2. The software
Data Center Simulator is a Windows application for designing, simulating and checking data center electrical and mechanical infrastructure. It runs entirely on your own computer, stores your projects on your own disk and does not require an internet connection to operate.
Two editions are available. The Demo edition is free, requires no licence key and is restricted in what it can export. The Professional edition is unlocked by a licence key and contains every feature.
3. The licence
A Professional licence grants you a personal, non-exclusive, non-transferable right to install and use the software on one computer for the term you paid for (one month or twelve months from the date the key is issued, unless a different term was agreed in writing). Company and Enterprise licences cover the number of computers and the term stated on their invoice.
The key is generated for a specific computer, identified by a Machine ID the software shows you. It does not work on any other computer. If you replace your computer, tell us and we will issue a replacement key for the new one at no charge, at which point the old key is retired.
A licence is a term, not a subscription. Nothing renews or is charged automatically. When the term ends, the software reverts to the Demo edition and your project files remain on your disk, readable by the Demo edition and by any future licence.
4. What you may not do
- Share, resell, lend or publish a licence key, or use one key on more than one computer.
- Reverse engineer, decompile, disassemble or otherwise attempt to extract the source code, the licensing mechanism or the calculation models of the software.
- Remove or alter any proprietary notice, or present the software or its output as your own product.
- Use the software to build a competing product, or to train a machine-learning system on its models or output.
- Circumvent, or attempt to circumvent, the restrictions of the Demo edition.
A breach of this section ends the licence immediately, without refund.
5. Price and payment
Prices are shown on the Licensing section of this site in US dollars and exclude any bank charges, currency-conversion fees or taxes that your bank or your jurisdiction may apply. Card payments are processed by XPay, a payment service provider licensed by the Central Bank of Egypt; your card details are entered on XPay’s secure page and are never seen or stored by us. Company and Enterprise licences may be paid by bank transfer against an invoice.
Prices may change. A change never affects a licence that has already been paid for.
6. Delivery
The software is delivered electronically. After payment you send us the Machine ID of the computer you will use; we issue the licence key and send it, together with the Professional edition installer and the Activation Guide, to the email address you gave at purchase. This is normally done within a few hours and always within one working day of receiving your Machine ID. Nothing physical is shipped.
7. Refunds
Our refund terms are set out in full in the Refund Policy, which forms part of these terms. In short: a full refund is available at any time before your licence key is issued, and within fourteen days of issue if the software cannot be made to run on your computer.
8. Engineering use and professional responsibility
The software is a design and analysis aid for qualified engineers. Its calculations follow published standards and engineering practice, and its compliance checks apply the published criteria of the Uptime Institute Tier classification, ANSI/BICSI 002, TIA-942 and the other standards it names. It does not replace the judgment of a qualified engineer, and its output is not a certification, an audit, or a statement by any standards body.
You are responsible for verifying every result before relying on it in a design, a tender, a report or a construction decision, for confirming that the standards and parameters you selected are the ones that apply to your project, and for complying with the codes and regulations of the place where the facility is built. Tier certification is granted only by the Uptime Institute; BICSI and TIA do not certify facilities through this or any other software.
9. Warranty and liability
We warrant that, for the licence term, the software will operate substantially as described on this site. If it does not, your remedy is that we correct the fault, or refund the price of the licence in accordance with the Refund Policy. Beyond that, the software is provided “as is”, and we make no other warranty, express or implied, including of fitness for a particular purpose.
To the fullest extent permitted by law, we are not liable for any indirect, consequential or special loss, for loss of profit, business, data or contracts, or for any loss arising from a design, report or decision that relied on the software’s output. Our total liability to you under these terms, for any cause, is limited to the amount you paid for the licence in question. Nothing in these terms limits liability that cannot be limited by law.
10. Intellectual property
The software, its models, its documentation and this website are the property of Eng. Moataz El Sherif and are protected by copyright. Buying a licence transfers no ownership. The projects, diagrams and reports you create with the software are yours.
11. Support
Professional and Enterprise licences include email and WhatsApp support from the engineer who built the software, for the duration of the licence, on installation, activation and use of the software. Support does not include reviewing or approving your designs.
12. Termination
Your licence ends when its term expires, or immediately if you breach section 4. You may end it at any time by uninstalling the software; ending it early does not entitle you to a refund except as set out in the Refund Policy.
13. Changes to these terms
We may update these terms; the effective date at the top changes when we do. A change applies to licences bought after it. The terms in force when you bought your licence continue to apply to that licence.
14. Governing law
These terms are governed by the laws of the Arab Republic of Egypt, and the courts of Cairo have jurisdiction over any dispute arising from them. Before any dispute reaches that stage, write to us: almost everything is settled by email in a day.
